Don't Give Polluters Immunity!
Your right to sue polluters to protect your family
and property is at stake!
The Texas House of Representatives
has amended Senate Bill 875 to grant basically blanket immunity
to polluters to shield those polluters from legal actions
that you – or
your city or county – might bring against them for
any personal injury or property damage they have caused
to you or your community through their actions.
To prevent a polluter from damaging your property or
injuring you or your family, you could bring what’s called
a nuisance action against them to get them to stop their
pollution practices and pay for any damages to your property.
The Bonnen amendment put on SB 875 on the House floor would
give a polluter an “affirmative defense” against
a civil suit against them as long as they have a pollution
permit from TCEQ (you know how good those permits are!)
and are in “substantial” (?!) compliance with
So even if the polluter is contaminating your groundwater
or fouling your air, you couldn’t sue them
if they have a pollution permit, regardless that the permit
is not protective of you, your family, your health, or
The amended bill now goes back to the Texas Senate
for action. Take action immediately to tell
your State Senator to refuse to concur in the House amendments
to Senate Bill 875 or, better yet, just let the bill
